Welcome to Ecomobi. By accessing or using our website ecomobiclub.com (the “Site”), placing an order, or using any of our services, you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, please do not use this Site or services.
1. Definitions
“We”, “us”, “our” refers to Ecomobi, the operator of this website.
“You”, “your”, “customer” refers to any person or entity accessing or using the Site or placing an order.
“Products” refers to any mobility scooters, accessories, parts, or other items sold via this Site.
“Order” means your request to purchase Products from us via the Site.
2. Use of the Site & Account
You must be at least 18 years old and have legal capacity to enter into a contract to use this Site.
You agree to provide accurate, current, and complete information when creating an account or placing an order.
You are responsible for maintaining the security of your account credentials.
We reserve the right to refuse or cancel orders, limit order quantities, or terminate access to accounts at our discretion (e.g. for suspected fraud, violation of these Terms, or for any reason).
3. Orders, Pricing & Payment
All orders are subject to acceptance and availability. We may refuse or cancel any order at any time.
Prices listed on the Site are in US dollars (USD) unless otherwise stated, and do not include taxes, duties, or shipping costs unless specified.
Payment must be made in full at the time the order is placed. We accept the payment methods shown on the Site (e.g. credit cards, PayPal, etc.).
In case of a pricing error (e.g. a typo), we reserve the right to cancel or refuse to honor the order even after you receive a confirmation.
4. Shipping & Delivery
Shipping methods, costs, and delivery estimates are shown on the Site and during checkout.
Free shipping may be available under certain conditions (e.g. minimum order amount) — refer to our Shipping Policy for details.
Once a product is dispatched, risk of loss or damage passes to you (unless stated otherwise or required by law).
We are not responsible for delays or failures in delivery caused by customs, courier issues, or issues outside our control.
5. Returns, Refunds & Warranty
Returns and refunds are governed by our Return & Refund Policy. You must comply with that policy to qualify for refunds or exchanges.
Unless otherwise specified, customers are responsible for return shipping costs.
We provide a warranty (for instance, a 1-year warranty) for certain Products against manufacturing defects. Warranty terms are described in our Warranty Policy.
Warranty does not cover damage caused by misuse, accidents, unauthorized modifications, or normal wear and tear.
6. Intellectual Property
All content on the Site (text, graphics, logos, images, software) is owned by or licensed to us and is protected by intellectual property laws.

You agree to indemnify, defend, and hold harmless Ecomobi and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Site, your breach of these Terms, or your violation of any law or rights of a third party.

We may modify or revise these Terms at any time. The updated Terms will be posted on the Site, and the “Last updated” date will be changed. If changes are material, we may also send you notice (e.g. by email). Your continued use of the Site after changes means you accept the new Terms.
10. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the state in which our company is registered (you may specify your state, e.g. Delaware, California, etc.), without regard to conflict-of-law principles.
Any dispute between you and us arising out of or related to these Terms or your use of the Site shall be resolved through binding arbitration (or small claims court for smaller claims) in the jurisdiction we specify.
If any provision is held invalid or unenforceable, that provision is severed, and the remainder of the Terms remains in full force.
11. Severability & Waiver
If any provision of these Terms is found invalid or unenforceable by a court, that provision will be deemed severable and will not affect the validity of the remaining provisions.
Our failure to enforce any right or provision under these Terms will not be considered a waiver of that right.
